{"id":2002,"date":"2020-09-14T17:45:26","date_gmt":"2020-09-15T00:45:26","guid":{"rendered":"https:\/\/www.crimeandconsequences.blog\/?p=2002"},"modified":"2020-09-14T17:45:26","modified_gmt":"2020-09-15T00:45:26","slug":"for-judge-amul-thapar-the-rule-of-law-counts","status":"publish","type":"post","link":"https:\/\/www.crimeandconsequences.blog\/?p=2002","title":{"rendered":"For Judge Amul Thapar, the Rule of Law Counts"},"content":{"rendered":"<p>Judge Amul Thapar is one of many excellent appointments President Trump has made to the federal courts of appeals.\u00a0 He showed it again in his opinion today for a unanimous Sixth Circuit panel that reversed, and removed from the case, a district judge disinclined to follow established law.\u00a0 The subtitle of Judge Thapar&#8217;s work could easily be, &#8220;Being A Judge Is A Job Not An Anointment.&#8221;<\/p>\n<p><!--more--><\/p>\n<p>As the National Law Journal <a href=\"https:\/\/www.law.com\/nationallawjournal\/2020\/09\/14\/discretion-is-not-unfettered-sixth-circuit-pulls-trial-judge-off-case-for-refusing-to-follow-their-ruling\/?kw=%27Discretion%20is%20Not%20Unfettered%27:%20Sixth%20Circuit%20Pulls%20Trial%20Judge%20Off%20Case%20for%20Refusing%20to%20Follow%20Their%20Ruling&amp;utm_source=email&amp;utm_medium=enl&amp;utm_campaign=newsroomupdate&amp;utm_content=20200914&amp;utm_term=nlj\">reports<\/a>:<\/p>\n<blockquote><p>A panel on the U.S. Court of Appeals for the Sixth Circuit ordered that a man be resentenced and his case reassigned to a different district judge after the trial court refused to give the man a new sentence in line with a prior ruling from the circuit.<\/p>\n<p>In an\u00a0<a href=\"https:\/\/www.opn.ca6.uscourts.gov\/opinions.pdf\/20a0306p-06.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">opinion<\/a>\u00a0issued Monday, Judge Amul Thapar wrote the appeals court had \u201cseen this case before,\u201d as it had previously sided with the government\u2019s appeal of a 12-month home confinement sentence handed down by U.S. District Judge Sheryl Lipman of the Western District of Tennessee to a man who pleaded guilty to child pornography charges. Judge Bernice Donald and Senior Judge Alice Batchelder also considered the appeal.<\/p>\n<p>The circuit court had previously found the sentence was \u201cunreasonable,\u201d as the sentencing guidelines called for the man, Dane Schrank, to serve 97 to 120 months in prison. But when the case was remanded to Lipman, she declined to impose a new sentence and criticized the Sixth Circuit \u201cfor \u2018second-guess[ing]\u2019 her sentence and said that she would not impose a sentence that \u2018does not make sense,\u2019\u201d according to Thapar\u2019s opinion.<\/p>\n<p>\u201cBut the district judge didn\u2019t stop there,\u201d Thapar continued. \u201cShe also found time to criticize the \u2018sophistication of the judges on the Sixth Circuit when it comes to computers\u2019 and said that Schrank\u2019s misconduct\u2014accessing the dark web over the course of five days and downloading nearly 1,000 images of children being raped\u2014was \u2018much less exaggerated\u2019 than \u2018the Sixth Circuit judges realize.\u2019 She concluded by noting, \u2018maybe the Sixth Circuit will reverse me again.\u2019\u201d<\/p><\/blockquote>\n<p>Good guess there, Judge Lipman!<\/p>\n<p>One can assume arguendo that there are two sides to the kiddie porn debate;
