{"id":2618,"date":"2020-12-18T15:39:36","date_gmt":"2020-12-18T23:39:36","guid":{"rendered":"https:\/\/www.crimeandconsequences.blog\/?p=2618"},"modified":"2020-12-18T15:47:54","modified_gmt":"2020-12-18T23:47:54","slug":"is-just-sentencing-racist","status":"publish","type":"post","link":"https:\/\/www.crimeandconsequences.blog\/?p=2618","title":{"rendered":"Is Just Sentencing Racist?"},"content":{"rendered":"<p><em>The claim repeated endlessly by liberal politicians, race hustlers and the mainstream media, that America\u2019s criminal justice system is racially biased has been debunked by studies and hard data many times, but it continues to dominate every discussion of criminal justice policy. \u00a0 Hans Bader&#8217;s piece below, addresses this claim, most recently made by newly elected Los Angeles District Attorney George Gasc\u00f3n:<\/em><\/p>\n<p>Punishment should be tailored to fit the crime, not ignore things that make a crime worse or more serious.\u00a0 Criminal&#8217;s punishment should be <a href=\"https:\/\/www.law.cornell.edu\/constitution-conan\/amendment-8\/proportionality\" target=\"_blank\" rel=\"nofollow noopener noreferrer\" shape=\"rect\">proportional<\/a> to their offense, according to Supreme Court rulings.\u00a0 That&#8217;s why sentencing enhancements <a href=\"https:\/\/www.nbclosangeles.com\/investigations\/los-angeles-county-district-attorney-george-gascon-crime-punishment\/2487559\/\" target=\"_blank\" rel=\"nofollow noopener noreferrer\" shape=\"rect\">exist<\/a> for crimes committed by repeat offenders, or for those who committ &#8220;<a href=\"https:\/\/abc7.com\/george-gascon-lada-los-angeles-county-district-attorney-cash-bail\/8781685\" target=\"_blank\" rel=\"nofollow noopener noreferrer\" shape=\"rect\">great bodily injury<\/a>.&#8221;\u00a0 But Los Angeles County&#8217;s progressive district attorney opposes them.<br \/>\n<!--more--><\/p>\n<p>&nbsp;<\/p>\n<p>He is refusing to seek the sentence enhancements required by California law, and is ordering prosecutors not to seek them. So serial killers who torture their victim to death will be eligible for parole, rather than getting life without parole or the death penalty.<\/p>\n<p>The district attorney says that he won&#8217;t enforce the sentencing enhancements mandated by state law because they are &#8220;racist.&#8221;\u00a0 NBC news <a href=\"https:\/\/www.nbclosangeles.com\/investigations\/los-angeles-county-district-attorney-george-gascon-crime-punishment\/2487559\/\" target=\"_blank\" rel=\"nofollow noopener noreferrer\" shape=\"rect\">reports<\/a>:<\/p>\n<blockquote><p>LA County District Attorney George Gasc\u00f3n said Tuesday no exceptions would be made to his new rule that bans prosecutors from filing sentencing enhancements in criminal cases, no matter how terrible the crime.<\/p>\n<p>\u201cI do believe that enhancements have driven mass incarceration in this country and I do believe that they\u2019re racist,\u201d he told reporters in a remote video news conference.<\/p>\n<p>Gasc\u00f3n\u00a0said people will still be prosecuted for the underlying crimes, but those convicted would likely serve far less time in prison once the enhancements that can add years for things like prior convictions&#8230;or the use of guns, are dismissed.<\/p>\n<p>\u201cTo believe for a moment that we are going to fix all of the social problems by putting people in a concrete box, is so wrong,\u201d he said.<\/p><\/blockquote>\n<p>Gasc\u00f3n&#8217;s office is now opposing sentence enhancements in cases of unusually cruel murders such as <a href=\"https:\/\/www.nbclosangeles.com\/investigations\/los-angeles-county-district-attorney-george-gascon-crime-punishment\/2487559\/\" target=\"_blank\" rel=\"nofollow noopener noreferrer\" shape=\"rect\">one where<\/a> &#8220;two men&#8221; were &#8220;burned to death in a deliberately-set fire at a recording studio,&#8221; and for a killer who <a href=\"https:\/\/www.foxla.com\/news\/da-gascons-policy-changes-include-dismissing-special-charges-against-accused-cop-killer\" target=\"_blank\" rel=\"nofollow noopener noreferrer\" shape=\"rect\">repeatedly<\/a> murdered police officers.<\/p>\n<p>Sentencing enhancements <a href=\"https:\/\/www.ncjrs.gov\/pdffiles1\/nij\/grants\/223854.pdf\" target=\"_blank\" rel=\"nofollow noopener noreferrer\" shape=\"rect\">seek to ensure<\/a> that more serious offenders and those with more extensive prior records receive more severe punishment. That is in keeping with the justice system&#8217;s goal of proportionality and non-discrimination between similarly-culpable offenders. Giving serious or repeat offenders the same sentence as first-time offenders or those who commit borderline violations is wrong and unfair. As the Supreme Court<a href=\"https:\/\/scholar.google.com\/scholar_case?case=6728702091269773312&amp;hl=en&amp;as_sdt=6&amp;as_vis=1&amp;oi=scholarr\" target=\"_blank\" rel=\"nofollow noopener noreferrer\" shape=\"rect\"> explained<\/a> in 1971, &#8220;the grossest discrimination&#8221; can result from &#8220;treating things that are different as though they were exactly alike.&#8221;<\/p>\n<p>The district attorney believes that sentencing enhancements are racist because offenders are disproportionately black and Hispanic. But the Supreme Court has rejected the argument that racial differences in punishment rates show racism, noting that they in fact reflect racial differences in the crime rate, which is <a href=\"https:\/\/www.ajpmonline.org\/article\/S0749-3797(18)31907-X\/pdf\" target=\"_blank\" rel=\"nofollow noopener noreferrer\" shape=\"rect\">far higher<\/a> among blacks. For example, the Supreme Court ruled that statistics showing a higher black arrest rate for many crimes did not show racial discrimination, in <a href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/517\/456\/\" target=\"_blank\" rel=\"nofollow noopener noreferrer\" shape=\"rect\"><em>United States v. Armstrong<\/em><\/a> (1996). As the Justices explained, it is wrong to assume &#8220;that people of <em>all<\/em> races commit <em>all <\/em>types of crimes&#8221; at the same rate, since that presumption is \u201ccontradicted by\u201d reality.<\/p>\n<p>Moreover, being soft on violent criminals will harm minorities most, because <a href=\"https:\/\/www.ncjrs.gov\/ovc_archives\/ncvrw\/2017\/images\/en_artwork\/Fact_Sheets\/2017NCVRW_Homicide_508.pdf\" target=\"_blank\" rel=\"nofollow noopener noreferrer\" shape=\"rect\">half<\/a> of all murder victims in recent years have been black. Being soft on violent minority offenders harms law-abiding minority people, who are the target of most minority criminals: as PolitiFact has <a href=\"https:\/\/www.politifact.com\/florida\/article\/2015\/may\/21\/updated-look-statistics-black-black-murders\/\" target=\"_blank\" rel=\"nofollow noopener noreferrer\" shape=\"rect\"> noted<\/a>, between 2010 and 2013, \u201c92 percent of blacks who were murdered were killed by other blacks.\u201d<\/p>\n<p>Gasc\u00f3n is specifically <a href=\"https:\/\/www.georgegascon.org\/\/wp-content\/uploads\/2020\/12\/SPECIAL-DIRECTIVE-20-08-.docx.pdf\" target=\"_blank\" rel=\"nofollow noopener noreferrer\" shape=\"rect\">targeting<\/a> for elimination the sentencing enhancements approved by California voters in Proposition 8. That ballot initiative increased penalties for repeat offenders <a href=\"https:\/\/www.nber.org\/papers\/W6484\" target=\"_blank\" rel=\"nofollow noopener noreferrer\" shape=\"rect\">who commit<\/a>\u00a0willful homicide, forcible rape, robbery, and aggravated assault with a firearm.<\/p>\n<p>Crime in California\u00a0<a href=\"https:\/\/www.nber.org\/digest\/oct98\/david-r-francis\" target=\"_blank\" rel=\"nofollow noopener noreferrer\" shape=\"rect\">fell significantly<\/a> after Proposition 8 was enacted. Three years after Proposition 8 was adopted, crimes punished with enhanced sentences <a href=\"https:\/\/www.nber.org\/papers\/w6484\" target=\"_blank\" rel=\"nofollow noopener noreferrer\" shape=\"rect\">had<\/a> &#8220;fallen roughly 20-40 percent compared to&#8221; crimes not covered by enhanced sentences. So refusing to seek those sentencing enhancements will raise the violent crime rate.<\/p>\n<p>Lawyers also fear that Gasc\u00f3n will turn lose serious child-abusers by dropping sentence enhancements. As <a href=\"https:\/\/abc7.com\/george-gascon-lada-los-angeles-county-district-attorney-cash-bail\/8781685\" target=\"_blank\" rel=\"nofollow noopener noreferrer\" shape=\"rect\">ABC 7 reports<\/a>:<\/p>\n<blockquote><p>In one case, a baby sitter is accused of beating a 6-month-old girl with a blunt object, shattering the baby&#8217;s skull and causing severe brain damage. The girl, now 3-years-old, is blind and forced to eat through a feeding tube.
