{"id":2675,"date":"2020-12-29T10:22:45","date_gmt":"2020-12-29T18:22:45","guid":{"rendered":"https:\/\/www.crimeandconsequences.blog\/?p=2675"},"modified":"2020-12-29T11:38:55","modified_gmt":"2020-12-29T19:38:55","slug":"judge-rejects-gascons-back-door-plea-deal","status":"publish","type":"post","link":"https:\/\/www.crimeandconsequences.blog\/?p=2675","title":{"rendered":"Judge Rejects Gasc\u00f3n&#8217;s Back Door Plea Deal"},"content":{"rendered":"<p>At a December 15 preliminary hearing in Los Angeles, a top advisor for the newly elected District Attorney George Gasc\u00f3n, offered a plea deal giving an alleged gang murderer 7 years in prison.\u00a0 Bill Melugin of Fox 11 <a href=\"https:\/\/www.foxnews.com\/politics\/gascon-adviser-sweetheart-deal-gang-murder-suspect\">reports<\/a> that a <a href=\"https:\/\/www.foxla.com\/news\/gascon-adviser-accused-of-offering-sweetheart-deal-to-gang-murder-suspect-behind-back-of-prosecutor\">transcript<\/a> of the hearing indicates that Mario Trujillo, a special advisor to Gasc\u00f3n, went behind the back of the Deputy District Attorney assigned to the case, offering a plea deal to the defense attorney of seven years with no enhancements or special circumstances. \u00a0 When the deputy prosecutor assigned to the case announced that under a special directive issued by Gasc\u00f3n, the DA&#8217;s office would not be seeking any sentencing enhancements or special circumstances in the interest of justice, the judge questioned the interest of justice behind reducing the murderer&#8217;s sentence.\u00a0 The deputy replied, &#8220;I believe that it is the new D.A.&#8217;s position&#8230;&#8230;that extended prison sentences in Los Angeles county are far too long;\u00a0 that they are costly and ineffective and harm people in underserved communities.&#8221;<\/p>\n<p><!--more--><\/p>\n<p>Later in the hearing, the defense attorney announced a plea bargain that would result in the defendant receiving a 7-year prison sentence.\u00a0 &#8220;Who did the offer come from?&#8221; asked the judge. \u00a0 &#8220;Mr. Trujillo,&#8221; the defense attorney replied.\u00a0 &#8220;Trujillo?\u00a0 I don&#8217;t know who that is,&#8221; said the judge.\u00a0 It turns out that Trujillo had told the defense attorney that he would be prosecuting the case without informing the court, the deputy assigned to the case or the supervising deputy.\u00a0 Learning this, the judge put the hearing over until December 28.\u00a0 At that hearing the supervising deputy told the judge the any offer made by Trujillo is invalid because it never went through his office.\u00a0 &#8220;Mario Trujillo bypassed all of that&#8230;..never once called the DA that&#8217;s actually prosecuting the case.&#8221;\u00a0 Learning this the judge said, &#8220;It&#8217;s a good thing&#8230;.because there is no way I could look at myself in the mirror with a plea bargain of seven years on this case.&#8221;<\/p>\n<p>The case of People v.
