Walters writes:<\/p>\n<blockquote><p>A political saga that began more than four decades ago came full circle last week when the state Supreme Court, including four Jerry Brown appointees, indirectly upbraided the former governor.<\/p>\n<p>Unanimously, the court declared that Proposition 57, a major criminal justice overhaul sponsored by Brown and overwhelmingly passed by voters in 2016, did what its critics said it would do, not what Brown told voters.<\/p><\/blockquote>\n<p><!--more--><\/p>\n<blockquote>\n<p style=\"text-align: center;\">*\u00a0\u00a0\u00a0\u00a0\u00a0 *\u00a0\u00a0\u00a0\u00a0\u00a0 *<\/p>\n<p>Critics of Brown\u2019s measure \u2014 the state\u2019s prosecutors, particularly \u2014 pointed out the anomaly, and complained that if passed, it could shorten the terms of some vicious predators.<\/p>\n<p>Brown responded by promising that by regulation, state prison officials would prohibit sex criminals from being paroled under Proposition 57 and voters apparently believed him.<\/p>\n<p style=\"text-align: center;\">*\u00a0\u00a0\u00a0\u00a0\u00a0 *\u00a0\u00a0\u00a0\u00a0\u00a0 *<\/p>\n<p>Cantil-Sakauye subtly but unmistakably criticized Brown for sloppy drafting of the ballot measure.<\/p>\n<p>\u201cHad the drafters of Proposition 57, and by extension the voters, intended to exclude inmates from nonviolent offender parole consideration based on prior or current sex offense convictions, it would have been a simple matter to say so explicitly,\u201d she said.<\/p>\n<p style=\"text-align: center;\">*\u00a0\u00a0\u00a0\u00a0\u00a0 *\u00a0\u00a0\u00a0\u00a0\u00a0 *<\/p>\n<p>Ironically and perhaps tragically, it was issued just weeks after voters rejected a measure, Proposition 20, that would have corrected the gaps in Proposition 57.<\/p>\n<p>Thus, there is an indelible stain on what Brown had said was one of his proudest achievements.<\/p><\/blockquote>\n<p>Tragic indeed. Would the vote on Proposition 20 have been different if the California Supreme Court had decided the case well before the election? The court granted review in the case on May 15, 2019. There was plenty of time to get it done.<\/p>\n<p>There is indeed a stain, but Brown still won the substantive battle. His initiative will drastically shorten the sentences of a great many criminals who deserve their long sentences, including &#8220;nonviolent&#8221; rapists. Many innocent people will be victimized by predators who should have been incapacitated in prison.
