The police officer who shot and killed Ashli Babbitt during the Jan. 6 riot<\/a> at the U.S. Capitol won\u2019t face federal criminal charges in connection with her death, the Justice Department said Wednesday.

\n\u201cBased on that investigation, officials determined that there is insufficient evidence to support a criminal prosecution,\u201d the Justice Department said in a statement announcing the closure of its probe. <\/p><\/blockquote>\n

It is indeed tragic that Ms. Babbitt, who from all accounts otherwise lived an upstanding life, went in for conspiracy theories and ultimately chose in participate in an invasion of our nation’s capital. That said, police officers are fully justified in using deadly force if necessary to resist a riot. If a rioter dies in a riot, the fault lies with the rioter, not the police.<\/p>\n
