Consistently with that reputation, the city council in 2019 <a href=\"https:\/\/www.kvue.com\/article\/news\/local\/homeless\/its-now-legal-for-homeless-to-camp-on-austin-streets\/269-04fbfe58-7a28-4410-89a0-b876e9afda93\">repealed<\/a> the ban on camping in the streets. Inconsistently with that reputation, the people reinstated the ban last Saturday.<\/p>\n<p>The vote was 57-43, according to <a href=\"https:\/\/www.kvue.com\/article\/news\/local\/texas\/austin-prop-b-camping-ban-reinstated-whats-next\/269-7eb2a893-cce8-4011-9e4b-001a762208e1\">this report<\/a> for KVUE. That is a reasonably healthy majority.<br \/>\n<!--more--><\/p>\n<p>Apparently the city council took too seriously the half-joking slogan &#8220;Keep Austin Weird.&#8221; Not that weird, the people replied.<\/p>\n<p>As the 2019 <a href=\"https:\/\/www.kvue.com\/article\/news\/local\/homeless\/its-now-legal-for-homeless-to-camp-on-austin-streets\/269-04fbfe58-7a28-4410-89a0-b876e9afda93\">story<\/a> on the repeal noted, police rarely cited anyone under the old ordinance. But the fact they could enabled them to get people to move along rather than squatting long term on a piece of public property, making it unusable for its intended use. This informal enforcement is an important part of policing, and it is important to prevent the downhill slide of a city into disorder.<\/p>\n<p>Boise&#8217;s camping ordinance was overturned by the Ninth Circuit. See <a href=\"http:\/\/www.crimeandconsequences.com\/crimblog\/2019\/10\/briefs-in-boise-homeless-campi.html\">this post<\/a> on the archive blog. Regrettably, the Supreme Court did not take the case up. But Austin is in the Fifth Circuit.
