{"id":3865,"date":"2021-05-27T10:21:23","date_gmt":"2021-05-27T17:21:23","guid":{"rendered":"https:\/\/www.crimeandconsequences.blog\/?p=3865"},"modified":"2021-05-27T10:22:18","modified_gmt":"2021-05-27T17:22:18","slug":"das-sue-to-block-inmate-releases","status":"publish","type":"post","link":"https:\/\/www.crimeandconsequences.blog\/?p=3865","title":{"rendered":"DAs Sue to Block Inmate Releases"},"content":{"rendered":"<p>44 elected District Attorneys filed a <a href=\"https:\/\/www.sacda.org\/wp-content\/uploads\/2021\/05\/COMPLAINT-FOR-DECLARATORY-AND-INJUNCTIVE-RELIEF.pdf\">lawsuit<\/a> in Sacramento Superior Court yesterday seeking to block the California Department of Corrections and Rehabilitation (CDCR) from granting early releases to 76,000 of the state&#8217;s most dangerous criminals.\u00a0 In a press <a href=\"https:\/\/www.sacda.org\/2021\/05\/26\/44-elected-district-attorneys-file-suit-challenging-the-early-release-of-76000-state-prison-inmates\/\">release<\/a>, Sacramento District Attorney Anne Marie Schubert, who is leading the effort, noted that on Friday, April 30, 2021 the CDCR announced &#8220;emergency regulations&#8221; to award increased good time credits to the bulk of inmates currently in prison.\u00a0 On May 17, 2021 the District Attorneys sent a <a href=\"https:\/\/www.sacda.org\/wp-content\/uploads\/2021\/05\/CDCR-letter.Repeal.Regs_.Final_..pdf\">letter<\/a> to the head of CDCR asking her to repeal the regulations and follow normal state rules for implementing a policy of this magnitude.\u00a0 CDCR did not respond to the letter.<\/p>\n<p><!--more--><\/p>\n<p>In their complaint for injunctive relief, the DAs argue that CDCR provided no evidence of an actual emergency to justify such a massive change in policy.\u00a0 It should be noted that the CDCR is an Executive Branch agency which operates under the direct authority of Governor Newsom.\u00a0 There are currently 96,793 inmates in California prisons and the Governor is authorizing the early release of 78.5% of them, including 63,000 serving time for violent crimes and 20,000 sentenced to life terms.\u00a0 These are rapists, child molesters, armed robbers and murderers.<\/p>\n<p>If anybody can explain why this is a good idea, I&#8217;d be delighted to hear from them.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>44 elected District Attorneys filed a lawsuit in Sacramento Superior Court yesterday seeking to block the California Department of Corrections and Rehabilitation (CDCR) from granting early releases to 76,000 of the state&#8217;s most dangerous criminals.\u00a0 In a press release, Sacramento District Attorney Anne Marie Schubert, who is leading the effort, noted that on Friday, April 30, 2021 the CDCR announced &#8220;emergency regulations&#8221;
