Despite recent violent protests and occupations, St. Louis is <a href=\"https:\/\/www.ksdk.com\/article\/news\/local\/st-louis-riots-missouri-attorney-general-says-circuit-attorney-not-prosecuting-criminals\/63-3cf5934f-623d-4f71-ac9f-05c2c2882b78\">not pursuing<\/a> cases for looting and rioting, while Portland <a href=\"https:\/\/katu.com\/news\/local\/multnomah-co-das-policy-on-protest-arrests-focused-on-property-damage-theft-violence\">isn\u2019t pursuing<\/a> charges for trespassing. Philadelphia <a href=\"https:\/\/whyy.org\/articles\/after-his-first-year-philly-d-a-larry-krasner-earns-praise-from-reformers-scorn-from-victim-advocates\/\">won\u2019t allow<\/a> prostitution charges. San Francisco is <a href=\"https:\/\/sfist.com\/2019\/11\/16\/boudin-will-not-prosecute-prostitution-public-camping-and-other-quality-of-life-crimes-once-sworn-in\/\">not prosecuting<\/a> indecent exposure offenses. Chicago <a href=\"https:\/\/www.dnainfo.com\/chicago\/20161215\/little-village\/kim-foxx-raises-bar-for-retail-theft-felonies\/\">declines arrests<\/a> for thefts of less than $1,000.<\/p><\/blockquote>\n<p><!--more--><\/p>\n<blockquote><p>Prosecutorial discretion historically has been defined as a case-by-case judgment about whether to charge someone with a crime and whether to permit a plea bargain to some agreed-upon sentence or take the case to trial. The discretion is exercised based on consideration of the facts of the case, the characteristics of the defendant, and factors related to the victim\u2026It requires a fact-intensive, case-specific analysis. Prosecutorial discretion does <i>not <\/i>grant prosecutors unfitted authority to negate the legislative process by simply delaying that and entire class of crimes will go unpunished.<\/p>\n<p>Prosecutors have not been granted a line-item veto to go through their respective criminal codes and simply cross out the laws that they personally don\u2019t like. Enacting or repealing criminal laws is a legislative task conducted by elected officials.
