{"id":4768,"date":"2021-10-13T15:11:21","date_gmt":"2021-10-13T22:11:21","guid":{"rendered":"https:\/\/www.crimeandconsequences.blog\/?p=4768"},"modified":"2021-10-13T15:12:32","modified_gmt":"2021-10-13T22:12:32","slug":"scotus-appears-poised-to-re-instate-death-penalty-for-boston-marathon-bomber","status":"publish","type":"post","link":"https:\/\/www.crimeandconsequences.blog\/?p=4768","title":{"rendered":"SCOTUS Appears Poised to Re-Instate Death Penalty for Boston Marathon Bomber"},"content":{"rendered":"<p>The Supreme Court today heard argument in one of the most prominent death penalty cases of the last few decades, that of Dzhokar Tsarnaev, the Boston Marathon bomber.\u00a0 News reports from the <a href=\"https:\/\/www.washingtonpost.com\/politics\/courts_law\/tsarnaev-marathon-bomber-supreme-court\/2021\/10\/12\/4be6a196-2b9f-11ec-985d-3150f7e106b2_story.html\">Washington Post<\/a> and <a href=\"https:\/\/www.cnn.com\/2021\/10\/13\/politics\/boston-marathon-dzhokhar-tsarnaev-death-penalty\/index.html\">CNN<\/a>\u00a0 &#8212;\u00a0 neither outlet being friendly to capital punishment\u00a0 &#8212;\u00a0 suggest that the Court will reverse the First Circuit and re-instate Tsarnaev&#8217;s thoroughly earned death sentence.<\/p>\n<p><!--more--><\/p>\n<p>The Post notes:<\/p>\n<div class=\"teaser-content\">\n<section>\n<div class=\"\">\n<div data-qa=\"drop-cap-letter\">\n<blockquote>\n<p class=\"font--article-body font-copy gray-darkest ma-0 pb-md\" data-el=\"text\">The Supreme Court on Wednesday seemed prepared to reinstate the death penalty for Boston Marathon bomber\u00a0<a title=\"www.washingtonpost.com\" href=\"https:\/\/www.washingtonpost.com\/world\/national-security\/tsarnaev-to-be-formally-sentenced-today-in-boston-marathon-bombing\/2015\/06\/24\/1cdf4fe6-1a6d-11e5-bd7f-4611a60dd8e5_story.html?itid=lk_inline_manual_1\" target=\"_blank\" rel=\"noopener\">Dzhokhar Tsarnaev<\/a>, despite aggressive questioning from the court\u2019s liberals about whether crucial evidence was kept from jurors who decided not to spare his life.<\/p>\n<\/blockquote>\n<\/div>\n<\/div>\n<blockquote>\n<div class=\"\">The court was <a title=\"www.washingtonpost.com\" href=\"https:\/\/www.washingtonpost.com\/politics\/courts_law\/supreme-court-boston-marathon-bomber\/2021\/03\/22\/cc42f3be-8b11-11eb-a730-1b4ed9656258_story.html?itid=lk_inline_manual_3\" target=\"_blank\" rel=\"noopener\">reviewing a decision\u00a0<\/a>by a three-judge panel of the U.S. Court of Appeals for the 1st Circuit. In July, the panel agreed with Tsarnaev\u2019s lawyers that the judge overseeing his 2015 trial did not adequately question potential jurors for bias in the case, which received massive publicity.<\/div>\n<\/blockquote>\n<\/section>\n<\/div>\n<div class=\"remainder-content\" data-gtm-vis-recent-on-screen-11017726_601=\"20194\" data-gtm-vis-first-on-screen-11017726_601=\"20194\" data-gtm-vis-total-visible-time-11017726_601=\"100\" data-gtm-vis-has-fired-11017726_601=\"1\">\n<section>\n<div class=\"\">\n<div data-qa=\"drop-cap-letter\">\n<blockquote>\n<p class=\"font--article-body font-copy gray-darkest ma-0 pb-md\" data-el=\"text\">In overturning Tsarnaev\u2019s death sentence, the panel also said some evidence was improperly withheld that might have indicated his older brother, Tamerlan, was more culpable for the bombing. Tamerlan Tsarnaev was killed as police closed in on the brothers days after the April, 2013 attack.<\/p>\n<\/blockquote>\n<p data-el=\"text\">In fact, the district court engaged in as exhaustive a voir dire as\u00a0 any I have encountered in more than 20 years as a federal prosecutor.<\/p>\n<p data-el=\"text\">Somewhat to my surprise, most of the Court&#8217;s unusually long 90-minute hearing was\u00a0 devoted to the contention that the district court erred in restricting a speculative line of mitigation evidence:<\/p>\n<blockquote>\n<p data-el=\"text\">Said Tsarnaev\u2019s lawyer at the Supreme Court, Ginger D. Anders: \u201cThe theory is that Tamerlan influenced Dzhokhar Tamerlan, indoctrinated Dzhokhar, and Dzhokhar radicalized because of Tamerlan, and Tamerlan was more likely to have led the bombings. I think Tamerlan\u2019s commission of a previous jihadist murder was directly relevant to that theory.\u201d<\/p>\n<\/blockquote>\n<div class=\"\">\n<div data-qa=\"drop-cap-letter\">\n<blockquote>\n<p class=\"font--article-body font-copy gray-darkest ma-0 pb-md\" data-el=\"text\">Tamerlan was implicated in those murders after the bombing and after his death. A man named Ibragim Todashev said Tamerlan had recruited him to rob three men in 2011. After they were bound, Todashev said, Tamerlan slashed their throats.<\/p>\n<\/blockquote>\n<\/div>\n<\/div>\n<div class=\"\">\n<div data-qa=\"drop-cap-letter\">\n<blockquote>\n<p class=\"font--article-body font-copy gray-darkest ma-0 pb-md\" data-el=\"text\">But as he was being interrogated, Todashev charged toward investigators, who shot and killed him.<\/p>\n<\/blockquote>\n<p data-el=\"text\">It might be useful to remember that the next time you hear some breathless story about how law enforcement shot an &#8220;unarmed&#8221; person.<\/p>\n<p data-el=\"text\">But I digress.\u00a0 Justices Alito and Kavanaugh were having none of the defense speculation about what what might have happened in the earlier case and what Tsarnaev might have thought about it:<\/p>\n<blockquote>\n<p data-el=\"text\">Justices Samuel A. Alito Jr. and Brett M.
