{"id":5893,"date":"2022-02-15T13:31:28","date_gmt":"2022-02-15T21:31:28","guid":{"rendered":"https:\/\/www.crimeandconsequences.blog\/?p=5893"},"modified":"2022-02-15T14:29:27","modified_gmt":"2022-02-15T22:29:27","slug":"the-diversity-scam","status":"publish","type":"post","link":"https:\/\/www.crimeandconsequences.blog\/?p=5893","title":{"rendered":"The Diversity Scam"},"content":{"rendered":"<p>It&#8217;s not news at this point that President Biden preemptively determined that he would exclude close to 95% of the population in looking for his first Supreme Court nominee, and restrict the search solely to black women.\u00a0 Excluding almost everyone in advance is a remarkably stupid way to go about making critical SCOTUS appointments, as <a href=\"https:\/\/abcnews.go.com\/US\/majority-americans-biden-nominees-supreme-court-vacancy-poll\/story?id=82553398\">three quarters of the electorate took little to time figure out<\/a>.\u00a0 The excuse being given for the blanket exclusion of black men, white men, white women, Hispanics, Asian-Americans and anyone else you can think of is\u00a0 &#8212;\u00a0 ready now?\u00a0 &#8212;\u00a0 <em>diversity<\/em>.<\/p>\n<p>That this is preposterous on its face is not the point I want to make, since that&#8217;s too obvious to be posting about.\u00a0 Instead, the point worth noting is that, according to one quite prominent leader in Washington, DC, it&#8217;s not really about diversity at all.<\/p>\n<p><!--more--><\/p>\n<p>I bring you today&#8217;s note from my friend Ed Whelan, writing in NRO&#8217;s Bench Memos:<\/p>\n<p>Okay, this is news from 2005. As Joseph Epstein reminds us in his\u00a0<em>Wall Street Journal<\/em>\u00a0<a href=\"https:\/\/eppc.us4.list-manage.com\/track\/click?u=be333e74ea841be93db60da61&amp;id=e97d3a0e83&amp;e=404dfc644b\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/eppc.us4.list-manage.com\/track\/click?u%3Dbe333e74ea841be93db60da61%26id%3De97d3a0e83%26e%3D404dfc644b&amp;source=gmail&amp;ust=1645042564089000&amp;usg=AOvVaw0qEp-zFjiA2MyN5PZfpLhE\">column<\/a>\u00a0today (nicely titled \u201cThe Unbearable Lightness of Biden\u201d):<\/p>\n<p>&nbsp;<\/p>\n<p style=\"text-align: center\">[Joe Biden] considers himself a champion of African-Americans, yet he eulogized Sen. Robert Byrd, a Klansman in his youth, and the longtime segregationist Sen. Strom Thurmond.\u00a0<u>The man who now promises to appoint a black woman to the Supreme Court is the same man who warned in 2005 that if President Bush nominated Judge Janice Rogers Brown, \u201cI can assure you that would be a very, very, very difficult fight and she probably would be filibustered.\u201d<\/u><\/p>\n<p>In his typical bumbling fashion, Biden actually botched his filibuster threat\u2014he couldn\u2019t keep those female judges straight\u2014and had to correct it. Here\u2019s the excerpt from the \u201cFace the Nation\u201d\u00a0<a href=\"https:\/\/eppc.us4.list-manage.com\/track\/click?u=be333e74ea841be93db60da61&amp;id=359d95ca1b&amp;e=404dfc644b\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/eppc.us4.list-manage.com\/track\/click?u%3Dbe333e74ea841be93db60da61%26id%3D359d95ca1b%26e%3D404dfc644b&amp;source=gmail&amp;ust=1645042564089000&amp;usg=AOvVaw0OxdXl7ifH60PI3RsM20vv\">transcript<\/a>\u00a0from July 3, 2005:<\/p>\n<p>&nbsp;<\/p>\n<p style=\"text-align: center\">Sen. BIDEN: And so I did not want to limit it to the committee but I did\u2013that did not mean that if you let it out of committee that you weren\u2019t eligible to filibuster it. And\u2013but I have no intention of filibustering, but he\u2013it depends on who the president sends. But I could see a circumstance\u2013for example,\u00a0<u>if he sent up Edith Jones I can assure you that would be a very, very, very difficult fight and she probably would be filibustered.<\/u><\/p>\n<p style=\"text-align: center\">Ms. GREENBURG: What about\u2026<\/p>\n<p style=\"text-align: center\">ROBERTS: Well, what\u2026<\/p>\n<p style=\"text-align: center\">Ms. GREENBURG: \u2026Janice Rogers Brown, someone else?<\/p>\n<p style=\"text-align: center\">Sen. BIDEN: Excuse me. I\u2019m not\u2013by the way, I misspoke.\u00a0<u>I misspoke. Janice Rogers Brown is what I meant to say.<\/u><\/p>\n<p>&nbsp;<\/p>\n<blockquote><p>Don\u2019t let Biden apologists pretend that Biden was just predicting a filibuster and not clearly threatening it. In a Senate with 55 Republicans, it is absurd to think that a filibuster might have succeeded without Biden\u2019s support. Biden was one of\u00a0<a href=\"https:\/\/eppc.us4.list-manage.com\/track\/click?u=be333e74ea841be93db60da61&amp;id=1f6739b567&amp;e=404dfc644b\" target=\"_blank\" rel=\"noopener\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/eppc.us4.list-manage.com\/track\/click?u%3Dbe333e74ea841be93db60da61%26id%3D1f6739b567%26e%3D404dfc644b&amp;source=gmail&amp;ust=1645042564089000&amp;usg=AOvVaw0JCpyOybrhY79irS00nnzN\">25 Democrats<\/a>\u00a0who tried to filibuster Samuel Alito\u2019s nomination, so he was hardly someone who would have been among the six votes needed to defeat a filibuster of Brown.<\/p>\n<p>Biden and other Democrats, it\u2019s worth emphasizing, so vigorously opposed Janice Rogers Brown\u00a0<em>in part<\/em>\u00a0<i>because of her race and (to a lesser degree) her sex<\/i>. They opposed her because of her judicial philosophy but their opposition was intensified because they especially despised the prospect of a libertarian conservative justice who was a black female.\u00a0 ###<\/p><\/blockquote>\n<p>***********************************************************************<\/p>\n<p>That then-Sen. Biden was resolute against what eventually could have been the first black woman on the Supreme Court tells you all you need to know about the authenticity of his present supposed love of &#8220;only-black-women-need-apply&#8221; diversity.<\/p>\n<p>It has zip to do with diversity.\u00a0 What it has to do with is, first, a political payoff to Rep. Jim Clyburn for Clyburn&#8217;s essential help is the South Carolina Presidential primary; and, second and more important, making it politically more awkward for Republicans to oppose what is likely to be a consistently pro-criminal vote (Judge Ketanji Brown Jackson, the leading contender, spent eight years zealously safeguarding the interests of criminals when she was in the Public Defender&#8217;s Office).\u00a0 Pres.
