{"id":6897,"date":"2022-06-21T09:02:17","date_gmt":"2022-06-21T16:02:17","guid":{"rendered":"https:\/\/www.crimeandconsequences.blog\/?p=6897"},"modified":"2022-06-21T09:03:14","modified_gmt":"2022-06-21T16:03:14","slug":"attempted-robbery-is-not-violent","status":"publish","type":"post","link":"https:\/\/www.crimeandconsequences.blog\/?p=6897","title":{"rendered":"Attempted Robbery Is Not Violent?"},"content":{"rendered":"<p>The U.S. Supreme Court continued its chip-by-chip undermining of federal sentence enhancements for violent crimes, making one more narrowing of the definition of &#8220;violent felony.&#8221; In <a href=\"https:\/\/www.supremecourt.gov\/opinions\/21pdf\/20-1459_n7ip.pdf\"><em>United States<\/em> v. <em>Taylor<\/em><\/a>, No. 20-1459, it&#8217;s attempted robbery under the Hobbs Act that bites the dust. This will come as no surprise to those who have watched the steady parade of decisions excluding from the term &#8220;violent felony&#8221; crimes that common sense would tell us are violent. See, e.g., <a href=\"https:\/\/www.crimeandconsequences.blog\/?p=3969\">this post<\/a>.<!--more--><\/p>\n<p>Justice Thomas dissents from this &#8220;30-year excursion into the absurd.&#8221;<\/p>\n<blockquote><p>Justin Eugene Taylor and an accomplice pulled a gun on a fellow drug dealer as they tried to rob him. During the attempted robbery, the victim was shot and killed. Taylor pleaded guilty to using a firearm during an attempted Hobbs Act robbery, which he conceded was a \u201ccrime of violence\u201d under 18 U. S. C. \u00a7924(c)(3). Taylor made that concession because threatening to shoot someone during a robbery is undoubtedly a violent act. Yet, the Court holds that Taylor did not actually commit a \u201ccrime of violence\u201d because a hypothetical defendant\u2014the Court calls him \u201cAdam\u201d\u2014could have been convicted of attempting to commit Hobbs Act robbery without using, attempting to use, or threatening to use physical force. <em>Ante<\/em>, at 5; see \u00a7924(c)(3)(A).<\/p>\n<p>This holding exemplifies just how this Court\u2019s \u201ccategorical approach\u201d has led the Federal Judiciary on a \u201cjourney Through the Looking Glass,\u201d during which we have found many \u201cstrange things.\u201d L. Carroll, Alice in Wonderland and Through the Looking Glass 227 (J. Messner ed. 1982). Rather than continue this 30-year excursion into the absurd, I would hold Taylor accountable for what he actually did and uphold his conviction.
