In NYC Self Defense = Murder
Progressive Manhattan District Attorney Alvin Bragg has charged a 61-year-old bodega worker with second-degree murder for defending himself against a habitual felon who attacked him. Security video provided here by the New York Post shows 35-year-old parolee Austin Simon walk behind the counter and attack Jose Alba, knocking him down and threatening him. Alba then grabbed a knife kept under the counter and fatally stabbed Simon. Alba, who had no criminal record, was charged with murder and thrown in jail on $250,000 bail. Simon’s girlfriend, who stabbed Alba in the arm during the attack, was not charged.
The incident began at 11:00 PM on July 1st, when Simon’s girlfriend tried to buy potato chips from Alba with a depleted EBT debit card. When Alba took the chips back, the girlfriend began arguing with him, then knocked several items off the counter and left, returning minutes later with Simon. Simon was on parole for assaulting a police officer when he attacked the much smaller and older Alba. He had at least eight prior arrests, including for assault, robbery, and assault during a domestic dispute.
Alba’s defense attorney was able to get his bail lowered to $50,000, and with the help of his boss, gain release from jail. A conviction for second degree murder carries a sentence of up to 25 years in New York.
With both property and violent crime out of control in New York City, DA Alvin Bragg has allowed theft and drug criminals to be released without bail and undercharged habitual felons, even those charged with robbery and gun crimes, in a woke effort at “reducing racial disparities.”
Alba should be given a medal for taking down the violent thug who attacked him. The DA’s office is scheduled to go before a grand jury to seek an indictment against Alba on Thursday.
