This Week at SCOTUS

Today is a virtual Monday at the U.S. Supreme Court, as yesterday was a federal holiday. The court announced an orders list, accepting one case for review. The question is whether the Department of Agriculture can be sued for violating the Fair Credit Reporting Act. We will not be on the edge of our chairs waiting for this one.

For most cases, litigants must ask the Supreme Court to review a case. Appeals of right are limited to a small category. For these discretionary reviews, it matters who is asking. The Solicitor General of the United States gets a yes about half the time. For the rest of us, it’s about 1%.

Opinions are expected on Thursday.
